Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:02/28/13 Location:Third Floor, Cyclotron Roof Condition:Where employees were working atop a work platform 74-1/2 inches high, while ready- mix concrete having a pH of 12, was being poured via a concrete pump truck, the nearest portable eyewash station was located on a level 74-1/2 inches below where the concrete was being poured, and around a corner, for a total distance of 92 to 100 feet away. Among other methods, one feasible and acceptable method to correct this hazard is to install self contained portable eyewash stations on the same work level, and within 10 seconds walking distance of where mechanical pumping/mixing of concrete is occurring, in accordance with American National Standards Institute ANSI Z358.1-2009, Section 5.4.2.n
