North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to fall hazards: a)warehouse - where employees were using a 14 foot Werner self supporting ladder in a closed position to access a mezzanine 9 foot high about a concrete floor. b)warehouse - where employees were using a closed 14 foot Werner self supporting ladder that was leaning against a 9 foot high wall, for accessing the mezzanine, that did not extend 3 foot rise above the mezzanine landing. ABATEMENT NOTE: a)One acceptable abatement method to correct this hazard is to install stairs with handrails to include mid rails. b)One acceptable abatement method to correct this hazard is to use an extension ladder, that is 3 foot higher than the mezzanine landing, for access. Reference: a)ANSI A14.5-2007 paragraph 9.3.1.2. "Self supporting ladders shall not be used as single ladders or in a partially closed position". b)ANSI 14.5-2007 paragraph 9.3.9. "A ladder shall not be used as a brace, skid, lever, guy or gin pole, gangway, platform, scaffold plank, material hoist, or for any other use which it was not intended, unless the manufacturer specifically recommends such use.
