North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his/her employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee were exposed to struck by. a)at the maintenance shop: on or about April 11, 2013, the employer allowed the employees to store approximately up to 10 Michelin bus tires model #305/85R22.5 fully inflated and with rims installed weighing approximately 200 pounds each, for a total load of approximately 2,000 pounds set on one individual carrier of a tire rack carrousel, the tire rack carrousel had a total of 7 carriers, a retrieval speed of 18 ft per minute and was approximately 20 feet high, the carriers had a load rating capacity of 1,850 pounds each. Reference: Tire Rack Carrousel manufacturer's reference section B(2)(b) reads: Capacity per carrier: 1,850 pounds. b)at the maintenance shop: on or about April 11, 2013, the employer allowed the employees to store approximately up to 10 Michelin bus tires model #305/85R22.5 fully inflated and with rims installed weighting approximately 200 pounds each, for a total load of approximately 2,000 pounds set on one individual carrier of a tire rack carrousel, the tire rack carrousel had a total of 7 carriers, a retrieval speed of 18 ft per minute and was approximately 20 feet high, the carriers had a load rating capacity of 1,850 pounds each, but the tire rack had no load rating label posted on it. Reference: Tire Rack Carrousel manufacturer's reference section B(2)(b) reads: Capacity per carrier: 1,850 pounds. d)at the maintenance shop: on or about April 11, 2013, the employer allowed the employees to store up to 10 Michelin bus tires model #305/85R22.5 fully inflated and with rims installed weighting approximately 200 pounds each, for a total load of approximately 2,000 pounds set on one individual carrier of a tire rack carrousel, the tire rack carrousel had a total of 7 carriers, a retrieval speed of 18 ft per minute and approximately 20 feet high, the carriers had a load rating capacity of 1,850 pounds each; the tire rack was showing physical damage including but not limited to loose chains, bolts missing washers, bent horizontal bars and possible cracks a the base of it and the employer had not inspected the tire rack carrousel as required by manufacturer's recommendations.
