North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)Yard, crushing, and unload areas of facility - Where an employee was operating a "John Deere" 230LC metal tracked excavator to unload and move scrap cars and metal with the rear glass being taped over causing the view to be obstructed. b)Yard, crushing, and unload areas of facility - Where an employee was operating a "John Deere" 544J rubber tire front end loader to unload scrap cars and metal with the left rear glass panel missing and being covered by a black plastic trash bag which caused the view to be obstructed. Abatement Note: Repair/Replace the cab glass, train employees to report any damaged/missing glass, and possibly add a metal cage type cab guard. Page 1-3-3 of the John Deere 230 LC excavator operators manual states Avoid backover accidents - Keep windows and mirrors clean, adjusted, and in good repair. Page 1-5-1 of the John Deere 230 LC excavator operators manual covers warning stickers, one of which states Do not remove window bars. If window is missing or broken, replace immediately. Page 2-2-7 of the John Deere 230 LC excavator operators manual states Immediately replace a missing or broken window. This page also states Never place any part of the body beyond the window frame. Replace missing or broken windows immediately. Page 2-2-12 of the John Deere 230 LC excavator operators manual states Important: Prevent cab electrical component damage from bad weather. Windows, roof vent, and cab door must be closed to prevent enter of rain.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush by hazards: a)Facility - Where an employee was observed operating a roll over protection (ROPS) equipped "Daewoo" LP type forklift (Model: G25S, S/N: 0-39247) while removing a barrel of cans from the scale without wearing the factory installed seatbelt. Abatement Note: Retrain employees on the safe use and operation of forklifts, and enforce the use of seatbelts while operating the forklift.
