North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall from elevation: a)Railsite, employees are accessing the top of the FLOX 983265 hopper railcar at a height of 15 feet 7 inches during sodium sulfate transfer operation to hook up and unhook exhaust and in-feed hoses without fall protection. NOTE:Among other methods, one applicable and feasible method to correct this hazard was to erect a guarded platform system to access the railcar hook up points.
