and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to struck by hazards:
a)on the site - an employee not involved in the tree
removal operation was allowed in the work area.
Among others, one feasible and acceptable method of
abating this violation is to ensure employees not
directly involved in the removal operation are clear of
the work area, where practicable, beyond the length of
the tree.
