North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to a crushed by hazard.
a)Public Works Facility (Truck Repair Shop):  where the employer could not
verify that periodic
qualified inspections for an ALM (Model 12001WR, 12,000lbs) automotive
lift, which had not
had a periodic inspection as required by ANSI/ALI-2000.

Standard for Automotive Lifts - SAFETY REQUIREMENTS FOR OPERATION,
INSPECTION AND MAINTENANCE.
ANSI/ASI - 2000 Periodic Qualified Inspection (Section 5.1, page 6):  The
owner or
employer shall establish a periodic inspection procedure in accordance
with the
recommendations of the lift manufacturer in order to ensure reliability
and allow the
continued safe operation of the lift.  Please be reminded that certain
sections of U.S.
Code of Federal Regulations, Title 29, Section 1910 and applicable
subparts -
Occupational Safety and Health Administration, General Industry Standards
may pertain
to the procedures anticipated by this section.  Compliance with applicable
regulations is
left to the person(s) involved.
Section 5 includes, but is not limited to:  Qualified Inspection
Procedure, Use of a
Qualified Inspector, Training for Inspector, Documentation of Inspection,
Frequence of
Inspection, Inspection Checklist, Inspection Points for All Lifts,
Inspections Points for
Hydraulic Lifts, Inspection Points for Mechanical Lifts, Inspection Points
for
Hydraulically Driven Mechanical Lifts, and Inspection Points for Pneumatic
Lifts.
One feasible and acceptable method of abatement is for the employer to
periodically retain a qualified
lift inspector to conduct and document a periodic qualified inspection of
the automotive lift.
