North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by or crushed by hazard: a)facility, loom beam area - where employees operated a 2 Ton CM Railstar (SN 078MG) underhung overhead hoist with steel chains without a safety latch on the hook to lift and move section beams weighing approximately 1,200 pounds. Among other methods, one feasible and acceptable method of abatement to correct this hazard is to affix a safety latch on the hook. (Reference: American Society of Mechanical Engineers, Overhead Hoists (Underhung), ASME B30.16-1998, paragraph 16-1.2.9 "Hooks shall be equipped with latches unless use of the latch creates a hazardous condition").
