North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in and tip over hazards: a)main plant, throughout - employee(s) operating a Komatsu, model # FG25ST-11, forklift to transport rack(s) of parts to and from the oven were not required to wear seat belt. b)main plant, shipping department - employee(s) operating a Komatsu, model # FG25ST-11, forklift to load and unload parts from delivery trucks were not required to wear seat belt. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to: require employees to wear seat belt when operating forklift. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to: obtain the load capacity for the "basket lifting" device.
