North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by or caught in-between hazards. a)facility, warehouse - where employees loaded and unloaded materials to/from unsecured steel racks. b)facility, warehouse - where employees worked in proximity to racks with damaged components, such as leg supports. Abatement Note: One feasible means of abatement would be to secure the storage racks to the floor to prevent them from tipping over, and to replace the storage racks with damaged leg supports.
