North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush injuries when working underneath a load: a)job site - where an employee was exposed to crush-by injuries when he went underneath an elevated excavator's (Komatsu PC 300 LC) bucket which was attached to a mobile conveyor via a metal chain during set up operations for the mobile conveyor. Reference: Komatsu PC300-LC Operation and Maintenance Manual, page 1-30. Abatement note: Re-training for employees to instruct them not to access the swing radius of the excavator during set up of the conveyor.
