North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to the hazard of being struck by falling truck bodies:
a)Service Pack area - where the in-house fabricated bracket
(below-the-hook lifting device) used by an employee to
lift truck bodies had not been tested to determine its
load rating.
b)Service Pack area - where the in-house fabricated bracket
(below-the-hook lifting device) used by an employee to
lift truck bodies did not indicate the rated load on the
lifting device.
Among other methods, one applicable and feasible method to abate
this hazard is to install a manufactured lifting device that is
load tested and visibly marked with the rated load capacity in
accordance with ANSI/ASME B30.20-1999.
