North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that the employee was exposed to a struck or crushed by hazard: A)facility - for the Toyota propane-powered forklift (model 42-5FGU15, SN70139, 1400 Lbs capacity) equipped with roll over protection system (ROPS) and was not provided with a seatbelt for operator use. Abatement Note: One means of abatement would be to purchase and install a new seatbelt equipment on all equipment with roll over protection devices according to the manufacturer's requirements.
