Code of Virginia - 40.1-51.1(a) - The employer, The Legacy at North
Augusta, did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
extremely cold temperatures which
could cause hypothermia or frostbite.  The emergency latch for the door on
the Penn Refrigeration walk-in
freezer, Serial # 5142310, in the kitchen was not operational which could
cause the employees to get trapped
inside the freezer with no way to get out.
Employees were exposed to extreme low temperatures which could cause
hypothermia or frostbite. The walk-in
freezer door in the kitchen of, The Legacy at North Augusta, 1410 A N.
Augusta Street, Staunton, VA, was
frozen and was not operational which would prevent employees from being
able to open the freezer door if they
became trapped inside. Among other methods, feasible and acceptable
methods to correct this hazard is to
maintain the equipment in the same condition as which it was built by the
manufacturer and to adhere to the
National Sanitation Foundation Standard 7 (NSF/ANSI 7 - 2009) which
requires that doors shall be capable of
being opened from the inside, even when locked.
