Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:On or About 08/05/13 Location:Tier 3-C Condition:An employee was not immediately notified of a direct physical threat from an inmate and was permitted to continue his job assignment(s). Among other methods, one feasible and acceptable abatement method to correct the hazard is to follow the Procedures outlined in the Division of Correction Directive, #50-3, to communicate and document threats received against correctional employees, from inmates, as required in Sections I through VIII of this Directive. (b)Date of Violation:On or About 08/05/13 Location:Tier 3-C Condition:Employees issued and fitted with security vests were not required to wear the vests. Among other methods, one feasible and acceptable abatement method to correct the hazard is to follow the Department of Corrections Information Bulletin, #11-11, Appendix #2, which requires employees fitted with security vests to wear the vests as part of their uniform. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
