North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to fire and explosion hazards:
a)production area, employees in the production area were
exposed to fire and explosion hazards in that the Kst of
the wood dust was 14.8, and the dust was classified as
Class II.
b)production area - sliding saw, the ductwork was not
connected to the dust collection system on or about July
9, 2013.
c)production area, metal duct work was not used throughout
the ventilation system.  Nonmetallic duct was used
throughout the facility. Reference NFPA 664 8.2.2.2.1.1.
d)production area, the ductwork throughout the system was
not grounded on or about May 14, 2013. Reference NFPA 664
8.2.2.2.1.8.
e)production area, the metal ductwork that was used through
the dust collection system including but not limited to
the CNC Router  was not equipped with a deflagration
relief vents and vent duct designed, insalled, and
maintained in accordance with NFPA 68.  Reference NFPA
664 8.2.2.2.4.
f)production area, compressed air that was used for
cleaning was operating above 15 p.s.i.  Reference NFPA
664 11.2.1.1(3).
g)production area, prior to cleaning the area the wood dust
was not vacuumed.  Reference NFPA 664 11.21.1.1 (1).
Abatement Note: Among others, one feasible and acceptable
method of abating this violation will include but not be
limited to ensuring that the ventilation systems are operating
according to the manufacturer's specifications. The local
ventilation systems flow rate and ductwork should be installed
and operating in accordance with NFPA 664 "Standard for the
Prevention of Fires and Explosions in Wood Processing and
Woodworking Facilities."  Additionally, a plan and schedule
should be developed to provide regular and frequent cleanup to
reduce dust accumulations.
