North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to a fall from height when working from a raised
skidsteer loader attachment:
a)jobsite-the employer was operating a Bobcat, model T190, serial number
527714056, skidesteer
loader to lift an employee, who was standing in the loader attachment,
installing transition
board. The employee was operating at a height of approximately 8' above
hard compacted dirt.
Among other means of abatement, one feasible method would be to use an
extension ladder to
reach the heights desired to install the freeze board.
