North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to struck by hazards:
a)at the facility, the cement powder storage bin C&W Anti-Overfill warning
system
sensors were not receiving power because the manual batch station control
panel
power key was turned off in the batch house and the piping system was not
supported when the elbow pipe was removed.
Among other methods, one feasible and acceptable method to abate this
hazard is to
independently power the C&W Anti-Overfill warning system sensors to ensure
that they
are operating at all times and provide adequate support for the piping
while removing
pipe sections.
