North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees, in that employees were exposed to
fall hazards:
a)1209 Hay St. - where one employee was installing painted wooden sign
boards
over the theater marquee with hand tools while standing on the nine-foot
high
roof of a covered-bed cargo truck without any type of fall protection
system in
use.
Abatement note: Among other methods, one feasible and acceptable abatement
method to correct
this hazard is to use appropriately designed personnel lifting equipment
such as scissors-lift type
vehicles or bucket trucks.
Or, in the alternative:
29 CFR 1910.132(d)(1)(i): The employer did not select, and have each
employee use, the types
of PPE that will protect the affected employee from the hazards identified
in the hazard
assessment:
