North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to being caught in a trash compactor due to the
switch being inoperative as outlined in
para 5.6.1, ANSI Z245.2-2008:
a)warehouse-cardboard and trash compactor used to crush boxes and other
material, had been
operated with keys broken off in the switch so the device could not be
turned off prior to
employees working on or loading the machine(ref para 5.6.1, ANSI
Z245.2-2008).
ONE FEASIBLE MEANS OF ABATEMENT IS TO ENSURE ALL SWITCHES ARE IN
WORKING ORDER PRIOR TO THE MACHINE BEING PUT IN SERVICE.
