Nevada Revised Statute 618.375(1):  Duties of employers.  Every employer
shall
furnish
employment and a place of employment which are free from recognized
hazards that are causing
or are likely to cause death or serious physical harm to his or her
employees:
At Rainaid's manufacturing facility, the employer did not furnish a place
of employment
free of recognized hazards when employees were exposed to storage racks
that were not
anchored down.  In the maintenance area, 3 storage racks were not anchored
down to
prevent movement exposing employees to crushing injuries like broken bones
and death
should the storage racks tip over and land on the employees.
ANSI MH16.1-(2008), Section 1.4.7 states in part, "All rack columns shall
be anchored
to the floor with anchor bolts capable of resisting the forces caused by
the horizontal and
vertical loads on the rack."
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD INCLUDES USING ANCHOR BOLTS TO
ATTACH THE RACKS TO THE FLOOR.
