Nevada Revised Statute 618.375(1): Duties of Employers. Every employer
shall furnish
employment and a place of employment which are free from recognized
hazards that are
causing or are likely to cause death or serious physical harm to his or
her employees.
At the Mattress Firm warehouse, twenty one (21) storage racks in which
mattresses,
boxes of pillows, and bed frames were being stored were not secured to the
floor to
prevent them from tipping over. The unsecured storage racks exposed
employees to
struck by and crushing hazards.
Reference: ANSI MH16.1 Specification for the Design, Testing, and
utilization of
Industrial Steel Storage Racks. Paragraph 1.4.7: Column Base Plates and
Anchors. The
bottom of all columns shall be furnished with column base plates, as
specified in Section
7.2. All rack columns shall be anchored to the floor with anchor bolts
capable of
resisting the forces caused by the horizontal and vertical loads on the
rack.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD WOULD BE TO ANCHOR THE STORAGE RACKS TO THE FLOOR.
