Nevada Revised Statute 618.375(1): Duties of employers. Every employer shall fur
nish employment and a place of employment which are free from recognized hazards
that are causing or are likely to cause death or serious physical harm to his o
r her employees. Within the maintenance area at the Llantera Tropicana workplace
, employees were exposed to the recognized hazard of crushing as a result of byp
assing the safety locks on automotive lifts in two instances. 1) All four air lo
cks were disengaged on one of the lifts (make: Rotary Lift, model: SM123-10, ser
ial number: JCY03D0005, lifting capacity: 12,000 pounds). Employees were using a
n air valve to lower the lift instead of a push button switch. The push button s
witch disengages the air locks in order to lower the lift, which resulted in byp
assing the safety locks. These deficiencies exposed employees to possible crushi
ng hazards as a result of the lift being fully lowered
and bypassing the safety locks. 2) Another lift (make: Bend Pac, Inc., model: HD
0-12LSX-B, serial number: 6026, lifting capacity: 12,000 pounds) that was being
used had a screwdriver holding the secondary lock. If one of the cables were to
break, the secondary lock would not allow the safety lock to engage. Two of the
cables for the lift were raised approximately 8-10 inches above the columns. The
cables are intended to be raised up to four inches above the column in order to
prevent friction amongst the cables, which could cause the cables to fray and b
reak. An air valve was also being used on this lift instead of a push button swi
tch, which resulted in bypassing the safety locks. These deficiencies exposed em
ployees to possible crushing hazards as a result of the lift being fully lowered
and bypassing the safety locks, and if any of the cables were to break.

(Operator Responsibilities): The lift owner or employer shall take all appropria
te steps to follow the recommended inspection procedures of the lift manufacture
r, but in no event shall the lift operator fail to inspect or take notice of the
following features on a daily basis: (1) Accessibility and readability of the o
perating procedures, safety tips and generic safety material; (4) Proper operati
on of the lift controls, restraints and locking devices. - Paragraph 5.5: Qualif
ied Inspection Frequency. Inspections by the owner or employer shall follow the
recommendations of the lift manufacturer as to frequency. Without regard to the
frequency of inspection specified by the lift manufacturer, whether it be weekly
,monthly, semi-annually, annually or on some other basis, the owner or employer
shall ensure that the points presented in 5.6 are inspected by a qualified lift
inspector as a minimum annual requirement.
- Paragraph 6.2.1: Repair Maintenance Procedure. The owner or employer shall per
form repair maintenance procedures whenever they are called for by the lift oper
ator, qualified lift inspector or preventive maintenance technician. Repair main
tenance shall be performed in accordance with the recommendations of the lift ma
nufacturer in order to ensure reliability and allow the continued safe operation
of the lift. One feasible and acceptable means of abatement is to follow the re
quirements of ANSI/ALI ALOIM-2000, and ensure that both lifts are inspected and
certified for use at least annually by a qualified person.ed
