Nevada Revised Statute 618.375(1): Duties of employers.  Every employer
shall furnish
employment and a place of employment which are free from recognized
hazards that are causing
or are likely to cause death or serious physical harm to his or her
employees.
At the Budget Rent A Car & Sales vehicle maintenance area, an automotive
lift was not
being operated in a safe manner as follows:
During an inspection of a Bend-Pak Pro Lift, (unknown serial number, or
lifting
capacity), record(s) of the periodic inspections and maintenance,
established
inspection procedures, and safety tips and warning labels, were not
maintained
as required by the American National Standards Institute (ANSI)/ ALI ALOIM
-
2008: Safety Requirements for Operation, Inspection and Maintenance.  The
following are instances in which the employer did not meet the
requirements:
-Paragraph 4.2.2.  ANSI/ALI ALCTV requires the lift manufacturer to
supply operating instructions, general safety information, safety tips and
warning labels with each lift manufactured.  The owner or employer shall
display these materials in a conspicuous location in the lift area.
-Paragraph 5.1.  The owner or employer shall establish a periodic
inspection procedure in accordance with the recommendations of the lift
manufacturer in order to ensure reliability and allow the continued safe
operation of the lift.
-Paragraph 5.4.  A record of each periodic inspection shall be prepared and
maintained noting the observations and findings of all points of inspection
recommended by the manufacturer as well as subsequent repairs or
replacements accomplished.
-Paragraph 5.5.  Inspections by the owner or employer shall follow the
recommendations of the lift manufacturer as to frequency.  Without regard
to the frequency of inspection specified by the lift manufacturer, whether
it be weekly, monthly, semi-annually, annually or on some other basis,
the owner or employer shall ensure that the points presented in 5.6 are
inspected by a qualified lift inspector as a minimum annual requirement.
-Paragraph 6.2.1.  The owner or employer shall perform repair
maintenance procedures whenever they are called for by the lift operator,
qualified lift inspector or preventive maintenance technician.  Repair
maintenance shall be performed in accordance with the recommendations
of the lift manufacturer in order to ensure reliability and allow the
continued safe operation of the lift.
One feasible and acceptable means of abatement is to follow the
requirements of
ANSI/ALI ALOIM-2008, and ensure that the lift is labeled, inspected and
certified, and
maintained by a qualified person.ed
