OSHA opens inspections for many reasons — routine scheduling under a national or local emphasis program, an employee complaint or referral, or a follow-up after a reported injury. Nevada Revised Statute 618.375(1): Duties of employers. Every employer
shall furnish
employment and a place of employment which are free from recognized
hazards that are causing
or are likely to cause death or serious physical harm to his or her
employees:
At the Thunderdome Theme Park at the Circus Circus Hotel and Casino, the
employer
did not ensure that employees were protected from the recognized struck-by
hazard
presented by a moving amusement ride. An employee was painting the control
booth of
the Thunderbirds ride (made by: A. ZAMPERLA, ride name: MINI JET 8 RED
BARON FISSA, serial number: MJO8FO75US94, ride speed: 6.5 miles per hour,
revolutions per minute: 7.4) while the ride was in motion. While painting,
the employee
was approximately 2 to 3 feet from the ride, exposing him to possible
serious injuries in
the event he was struck by the ride's moving parts.
One feasible and acceptable means of abatement is to train employees on
the hazards
associated with entering the ride area, while the ride is in operation.
