Labor and Employment Article, Section 5-104(a): The employer did not
furnish employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death or serious
physical harm to employees:

Equipment:Encon Self Contained Portable Eyewash, Model #01104050
Condition:Where a self contained portable eyewash station was provided for
employee use, the
self contained eyewash station was not filled with flushing fluid per
manufacturer's
instructions, nor was the installation visually checked and verified for
compliance with
the manufacturer's instructions, and it was located approximately 75 feet
away from
where employees mix Portland cement, a corrosive material, with a
mechanical mixer.
Among other methods, one feasible and acceptable method of abatement is to
fill,
locate, install, inspect, and
verify the functionality of self contained portable eyewash stations in
accordance with American National
Standards Institute ANSI Z-358.1-2009, sections 6.4.1; 6.4.2; 6.4.8.;
6.5.1; and 6.5.3.
