11.5.1 NMAC Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): The employer did not furnish earch of his employees employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: Employees working at the outside load/unload area of the production room are exposed to the hazard of operating powered industrial trucks without having installed seatbelts. Thus, employees are working in an environment that is not free of recognized hazards as further evidenced by requirements of ASME/ANSI B56.1a and ASME B56.1 - 1993 safety standards for low lift and high lift trucks.
