HAR 12-60-2(a)(3) Every employer shall provide safe work places and
practices by
elimination or reduction of existing or potential hazards.  Elimination of
existing or potential
hazards by design, process substitution, or other appropriate methods is
preferred because it
eliminates the need for further employee protection.  When elimination is
not feasible,
reduction of existing or potential hazards to acceptable levels, using
methods such as
engineering or administrative controls, isolation, or guarding, shall be
promptly used.  When
these methods are inadequate to reach acceptable levels, personal
protective equipment shall
be provided and used.
Northwest wall, Warehouse Bay - The employer did not furnish employment
and a place of
employment which were free from recognized hazards that were causing or
likely to cause
death or serious physical harm to employees, in that employees were
exposed to being struck
and crushed by falling steel storage racks and/or components of the steel
storage racks,
including any materials stored on the racks as a result of their improper
use.  a) the employer
failed to ensure that all steel storage rack columns were anchored to the
floor; b) steel
storage racks with damaged or bent columns were not immediately unloaded
and the
damaged portions were not repaired or replaced.  ANSI MH16.1:2008,
Specification for the
Design, Testing, and Utilization of Industrial Steel Storage Racks,
Section
1.4.7 states "The
bottom of all columns shall be furnished with column base plates, as
specified in Section 7.2.
All rack columns shall be anchored to the floor with anchor bolts capable
of resisting the
forces caused by the horizontal and vertical loads on the rack."  Section
1.4.9 states "Upon
any visible damage, the pertinent portions of the rack shall be unloaded
immediately by the
user until the damaged portion is repaired or replaced."  Among other
methods, one feasible
and acceptable method to correct this hazard is to install storage rack
systems in accordance
with ANSI MH16.1:2008, Sections 1.4.7, and 1.4.9, respectively.
