Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:06/03/14 Location:Construction Yard Condition:An employee was operating a rough terrain forklift without using the provided seatbelt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use the seat belt provided on the forklift as per company policy for seat belt usage and enforcement of use by management required in this policy titled "Powered Industrial Lift Trucks." This policy can be referenced for the enforcement, training and requirements of the policy in Section 4 "Responsibility", Section 8 "New Employee Training," Section 8.1.5 "Seat Belts" and Section 10.1.6 "Seat Belts."
