Note 1) An Exposure Control Plan shall contain at least the elements contained in 29 CFR 1910.1030(c)(1)(ii). Note 2) Abatement certification is required for this item.

29 CFR 1910.1030(f)(2)(i): Hepatitis B vaccination was not made available and the training required in paragraph (g)(2)(vii)(I) within 10 working days of initial assignment had not been provided to all employees who have occupational exposure unless the employee has previously received the complete hepatitis B vaccination series, antibody testing has revealed that the employee is immune, or the vaccine is contraindicated for medical reasons: a) Facility: On or about March 9, 2011 and times prior thereto, the employer had not made available to hepatitis B vaccination series to designated collateral duty first aid responders. Note 1) The hepatitis B vaccination series must be made available as soon as possible, but no later than 24 hours, to all unvaccinated providers who have rendered assistance, regardless of whether or not a specific exposure incident, as defined by 29 CFR 1910.1030, has occurred. Note 2) Abatement certification is required for this item.

29 CFR 1910.146(k)(1)(ii): The employer did not evaluate a prospective rescue service's ability, in terms of proficiency with rescue-related tasks and equipment, to function appropriately while rescuing entrants from the particular permit space or types of permit spaces identified: a) Facility: On or about January 22, 2011, Stimson Lumber Company conducted permit-required confined space entry for repairs of the refractory lining in Boiler Cells #1 and #2. The employer designated 911 services as their rescue services during this entry. Prior to this work, the employer did not evaluate the emergency responder ability to rescue employees within these confined spaces. Note) Abatement certification is required for this item.
