29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:      a) Jobsite: On March 18, 2011 and times prior thereto, employees worked in a trench that was estimated to be 40 to 50 feet long and, approximately eight to ten feet deep with a single ladder located at the rear of the trench.

29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:    a)Jobsite: On March 18, 2011 and times prior thereto a support system was not in place for the rear patio structure where the area had been excavated, exposing employees working in that area to a potential collapse of the structure.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a)Jobsite: On March 17, 2011 and times prior thereto employees working in the trench were exposed to the hazard of having the excavated materials (spoil piles) placed on or near the edge of the excavation.      b) Jobsite: On March 18, 2011 employees working within a timber shoring system, were exposed to the hazard of excavated materials where at least two feet of the excavated walls on either side were not supported or shielded.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:      a) Jobsite: On March 17, 2011 and times prior thereto, a competent person did not conduct an inspection of a trench which measured approximately seven to ten feet deep, four to six feet across, and had vertical walls, to determine the proper protective system needed prior to allowing employees to enter the trench and perform work activities which included, but were not limited to digging for sewer and water lines.     b) Jobsite: On March 18, 2011 a competent person did not conduct an inspection of a timber shoring system to ensure the system shielded or supported the excavated vertical sides of the trench prior to allowing employees to enter and perform work within the trench and shoring system.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):      a) Jobsite: On March 17, 2011 and times prior thereto, a means of protection was not in place prior to allowing employees to enter a trench which measured approximately eight to ten feet deep, with vertical sides and perform activities which included but were not limited to digging for water and sewer lines.      b) Jobsite: On March 18, 2011 employees were allowed to enter and perform work within a timber shoring system which did not shield or support at least two feet of the vertical trench on both sides.
