29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    a)  Jobsite: On March 23, 2011 and times prior thereto, an employee was allowed to work around an excavator bucket without head protection while laying pipe.    b)  Jobsite:  On March 23, 2011 and times prior thereto, an employee was using a Stihl cut-off saw without a hard hat on to prevent head injuries from flying metal pieces from a possible saw blade failure.       Note:  Abatement certification is required for this item.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    a) Jobsite:  On or about March 23, 2011 and times prior thereto, an empoyee was using a Stihl TS 700 cut-off saw to cut out an opening on a concrete collection box without eye protection, while another employee watched within 3' of the cutting operation.    Note: Abatement certification is required for this item.

29 CFR 1910.134(d)(1)(iii): This provision is applicable to construction employment by 1926.103. The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants chemical state and physical form:    a) Jobsite:  On March 23, 2011 and times prior thereto, employees were not wearing respiratory protection while directed to cut concrete with a Sthil cut-off saw in an environment that had not been adequately evaluated for hazards such as crystalline silica in the concrete dust.    Note: Abatement certification is required for this item.
