29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)The Roofing Company @ 2399 North Frontage Road, Vail, CO 81657: On or before 3/30/11, the employer did ensure that safety inspections regarding the use of fall protection was conducted. Employees were observed working near the edge of a low-sloped roof. This condition exposed employees to a fall hazard greater than 25ft above the ground and 14th above a second story patio.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, were not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail systems, warning line system and personal fall arrest system, or warning line system and safety monitoring system: (a)The Roofing Company @ 2399 North Frontage Road, Vail, CO 81657: On or before 3/30/11, the employer did not ensure that fall protection systems were utilized by employees while conducting metal roof and flashing installation on the West Vail Fire Station. Employees were exposed to a measured fall distance greater than 25' from the ground and greater than 14' from the second floor patio below. The Roofing Company was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.501(b)(10) which was contained in OSHA Inspection 310467725, citation number 1, item number 2, issued on 8/29/2007, with respect to a workplace located at 38392 US Hwy 6 & 24, Avon, CO 81620. The Roofing Company was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.501(b)(10) which was contained in OSHA Inspection 313410789, citation number 2, item number 1, issued on 9/25/09, with respect to a workplace located at 202 Kamm Avenue, Castle Rock, Co 81647.
