29 CFR 1926.501(b)(4)(ii):     Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:     (a) John Rohrer Contracting Co, Inc. @ 8500 Pena Blvd, Denver, CO 80249: On and before 4/5/11, the employer did not ensure that holes generated via pneumatic hammer/chiseling (i.e. jackhammering) were promptly covered. Employees used 15 pound jackhammers (chicken hammers) to perform full depth concrete repairs on the Mod 3, Level 5, east parking garage. The concrete reinforcing wire mesh structure remained in place following the removal of the concrete in the, approximately, 2.5 x 16 exposed area. This condition exposed employees to cuts, lacerations, and bruises.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was required to use the respirator in the workplace.     (a) John Rohrer Contracting Co, Inc. @ 8500 Pena Blvd, Denver, CO 80249: On and before 4/5/11, the employer did not ensure that medical evaluations were provided to all employees prior to issuance and subsequent required use of respirators. An employee engaged in pneumatic hammer/chisel (i.e. jackhammering) removal of concrete was equipped with 3M half-face, tight-fitting air purifying respirator outfitted with P100 filters. This employee was provided a medical evaluation 13 days after the start of the inspection, 4/18/11. This condition exposed an employee to respiratory hazards.

29 CFR 1910.134(f)(1): The employer did notl ensure that all employees using a tight-fitting facepiece respirator passed an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):     (a) John Rohrer Contracting Co, Inc. @ 8500 Pena Blvd, Denver, CO 80249: On and before 4/5/11, the employer did not ensure that fit tests were provided to each employee prior to the required use of respirators. An employee, engaged in pneumatic hammer/chisel (i.e. jackhammering) removal of concrete, was equipped with 3M half-face, tight-fitting air purifying respirator outfitted with P100 filters. This employee was fit tested 3 days after the start of the inspection, 4/8/11. This condition exposed an employee to respiratory hazards.     29 CFR 1926.103: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter.

An employee engaged in pneumatic hammer/chisel (i.e. jackhammering) removal of concrete was equipped with 3M half-face, tight-fitting air purifying respirator outfitted with P100 filters. This employee was provided respiratory protection training 3 days after the start of the inspection, 4/8/11. This condition exposed an employee to respiratory hazards.
