29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1): (a) Wellshire LLC dba Wellshire Inn at 3333 S Colorado Blvd, Denver, CO 80222: On and before April 6, 2011, the building and/or facility owner did not, before work subject to this standard began, determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site pursuant to paragraph (k)(1) of this section. Subcontractors performed remodeling work on the first floor holding area (Onyx and Veranda rooms) of the facility. Presence, location, and quantity of ACM and PACM building materials such as, but not limited to, drywall with surface texturing were not determined prior to the start of work. This condition potentially exposed employees to an asbestos hazard. Abatement Note: Abatement certification is required for this item (see enclosed Sample Abatement Certification Letter).

29 CFR 1926.1101(k)(2)(ii)(C): The building owner and/or facility owner did not notify all employers of employees who work within or adjacent to the areas containing asbestos containing materials (ACM) and/or presumed asbestos containing materials (PACM) of the presence, location and quantity: (a) Wellshire LLC dba Wellshire Inn at 3333 S Colorado Blvd, Denver, CO 80222: On and before April 6, 2011, the building and/or facility owner did not notify all employers of employees who work within or adjacent to asbestos containing material and/or presumed asbestos containing material of the presence, location, and quantity of all ACM and/or PACM at their worksites in their building. Subcontractors performed remodeling work on the first floor holding area (Onyx and Veranda rooms) of the facility. Remodeling work included, but was not limited to, removal of drywall with surface texture. The building and/or facility owner did not inform all employers of employees who worked within or adjacent to the areas containing ACM and PACM of the presence, location, and quantity of these materials. This condition potentially exposed employees to an asbestos hazard. Abatement Note: Notification either shall be in writing, or shall consist of a personal communication between the owner and the person to whom notification must be given or their authorized representative. Abatement Note: Abatement certification is required for this item (see enclosed Sample Abatement Certification Letter).
