Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to impact injuries:    a) On or about April 13, 2011 and times prior, press operators were using dies that were not tested and rated to identify their tonnage and safe compression loading. American National Standards Institute (ANSI) B11.2-1982, paragraph 6.2(1) states: "All dies shall be: (1) Identified with the tonnage and, if necessary, stroke requirements; and/or those characteristics shall be recorded and available to the die setter". The dies were shop made and the employer was not able to determine the load that could safely be applied to the die exposing the press operator to serious injuries in the event of the failure of the die from overloading the die.    Abatement Verification:  Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
