29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides:    a) On or about April 8, 2011 and time prior, employee were exposed to injuries from falls greater than four feet to the lower surface when applying product onto the interior walls of a tank.    Abatement Note:  When working in a tank applying product the employer could erect a scaffold within the interior perimeter of the tank. This scaffold when erected properly would allow the employees to apply the product from a walking/working surface that would be an alternative to a standard fall protection systems.    Abatement Verification:  Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").

29 CFR 1910.134(c)(1):  A written respiratory protection program with worksite-specific procedures was not established and implemented at the workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer:    a) On or about April 8, 2011 and times prior, the employer had not established and implemented a written Respiratory Protection program.    Abatement Note:  The respiratory protection program shall include the elements listed in 29 CFR 1910.134(c)(1)(i)-(ix).    Abatement Verification:  Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").

29 CFR 1910.134(i)(5)(i):  The employer did not ensure that compressors used to supply breathing air to respirators are constructed and situated so as to prevent entry of contaminated air into the air-supply system:    a) On or about April 8, 2011 and times prior, employees were exposed to potential hazards from utilizing a supplied air respirator, to perform spraying application. The supplied air compressor filter had not been serviced thus allowing potentially contaminated air to enter the system.

29 CFR 1910.146(c)(4):  When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:    a) On or about April 8, 2011 and times prior, employees were exposed to injury/illness in that, the employer did not develop and implement a permit space entry program or any of its elements prior to employees entering the permit required confined spaces (tank).    Abatement Note:  Among other elements, a written permit space entry program includes:  	(1) Implementing measures necessary to prevent unauthorized entry;  	(2) Identifying and evaluating the hazards of the permit space entry;  	(3) Developing means, procedures and practices for confined space entry;  	(4) Providing appropriate equipment such as but not limited to air monitors,  	     ventilation equipment and communication equipment;  	(5) Evaluating permit space conditions prior to entry;  	(6) Ensuring appropriate personnel, including attendant is present;  	(7) Use of written permits.    Abatement Verification:  Abatement certification documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) On or about April 8, 2011 and times prior, a written Hazard Communication program was not implemented for employees exposed to such as but not limited to toluene.    Abatement Note: A hazard communication program includes employee training as well as a written program including material safety data sheet and a master list of all chemicals.
