29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) Jobsite: On or about March 30, 2011 and times prior thereto, the controlling employer Hoffman Contractors, Inc., did not ensure that its sub-contractor protected its employees who performed water pipe installtion activities outside of the protective trench shield. These activities included but were not limited to cutting the pipe, installing seals and locks at the pipe joints, and checking grade on the trench. b) Jobsite: On or about March 30, 2011 and times prior thereto, the controlling employer, Hoffman Contractors, Inc., did not ensure that its sub-contractor protected its employees while installing an air vac vault structure without a protective system in place. Note) Abatement certification is not required for this item.
