Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a the hazard of being being thrown outside the protective cage in the event of overturn. (a) Dick's Sporting Goods, Pocatello, ID: On or about March 9, 2011, and at times prior thereto, the employer did not instruct and/or enforce the utilization of the seat belts by operator(s) of the forklift(s). Note (1): Amongst other methods, several feasible and acceptable methods to correct this hazard are by complying with the manufacturer's operation guide regarding use of the manufacturer supplied seat belt and/or QNWI/ITSDF B56.1-2005 (Reaffirmation of ASME B56.1-2004), Section 7.41, Operator Restraint Systems. Note (2): Abatement certification and documentation ARE required for this item.

29 CFR 1910.178(l)(1(i): This provision is applicable to construction employer by 1926.602(d): Powered industrial truck operator did not receive initial training in the: Operating instructions, warnings, and precautions for the types of truck the operator was authorized to operate: (a) Dicks Sporting Goods, Pocatello, ID: On or about March 9, 2011, and at times prior thereto, employees had not received initial training specific to the safe operating parameters of a CAT TH 83 rough terrain material lift prior to utilizing it for hoisting and placing masonry brick on a scaffold. Note: Abatement certification and documentation ARE required for this item.
