29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) Apex Roofing, 143 Mesa Street, Brighton, CO: The controlling employer in charge of the worksite had not ensured that frequent inspections of the jobsite were conducted by a competent person to determine that appropriate fall protection was installed prior to removing and installing new shingles on teh 2 story residence. On or about April 18th, 2100, employees of the sub-contractor installing shingles on teh 6/12 pitch roof were not utilizing appropriate fall protection. Condition exposed employees to a fall hazard of approximately 18 feet. Abatement note: OSHA defines a Competent Person as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a) Apex Roofing Consultants, LLC, 143 Mesa Street, Brighton, CO: The controlling employer in charge of the worksite had not ensured the use of fall protection for employees of the sub-contractor removing and replacing composite shingles on teh 6/12 pitch roof. Condition exposed employees to a fall hazard of approximately 18 feet. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
