OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) On or about March 29, 2011, and at times prior employees were exposed to fall hazards from a scisor lift used during balcony remodeling activities at 1300 S. Parker Road in Denver, Colorado: 1) Employees climbed up the rails and out of the scissor lift onto second story and third story balconys without being tied off. 2) Employees did not secure the chain and bar guard rails across the access end of the scisor lift before raising the lift greater than 6 feet from the ground.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) On or about March 29, 2011, and at times prior, employees climbed 3 and 4 steps up on step ladders on balconies next to the railing without additional guard rails across the opening and were exposed to falls in excess of 12.3 feet while repairing and painting at 1300 S. Parker Road in Denver, Colorado.
