Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to amputation hazards: a) On or about April 13, 2011, and at times prior, a bandsaw located in the Gas Price Sign Shop was modified such that the original on and off control buttons were replaced with an unlabelled toggle switch. This created the hazard of the bandsaw restarting automatically in the event of an interruption of electrical power supply.

Noise dosimetry was conducted and it was determined that employees were exposed to noise levels above the action level in several areas of the shop.

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6: a) On or about April 13, 2011, and at times prior, employees were exposed to fire hazards, in that, the oxygen cylinders were stored directly along the primary route of egress, within the exit access near the Gas Price Sign Shop. According to the Compressed Gas Association Pamphlet P-1-1065, Section 3.3.1, cylinders shall be stored in accordance with National Fire Protection Association (NFPA) guidelines. NFPA 55 Standard for the Storage and Handling of Compressed Gases 2005 Section 7.7.2 states that oxygen cylinders shall be stored no less than 5 feet from a means of egress.
