29 CFR 1926.451(h)(2): Employees working below scaffolds were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section: a)The employer had not ensured the use of toeboards and/or barricades to prevent employees from being struck by falling material. On or about April 1, 2011, an employee was working on the ground next to a 4 section high scaffold while two employees installed stone material to the exterior of the building above. Abatement Note: Per CFR 29 1926.451(h)(2)(i) and (ii) an employer may use the following provisions to protect employees from the hazards associated with falling tools, materials, or equipment from scaffolds. i) The area below the scaffold to which objects can fall shall be barricaded, and employees shall not be permitted to enter the hazard area; or ii) A toeboard shall be erected along the edge of platforms more than 10 feet above lower levels for a distance sufficient to protect employees below.
