29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system:    (a)  Randy Connor at 1130 Lehigh St in Boulder, CO 80305:  On and before April 29, 2011, the employer did not ensure that employees were protected from injury, in that four employees removing shingles from a 4-in-12 pitch roof on a two- story residential home were not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 13 feet.    (b)  Randy Connor at 1130 Lehigh St in Boulder, CO 80305:  On and before April 29, 2011, the employer did not ensure that employees were protected from injury, in that four employees removing shingles from a 4-in-12 pitch roof on a one- story residential home garage were not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 8 feet.

29 CFR 1926.1053(b)(4):  Ladders were used for purposes other than the purposes  for which they were designed:    (a)  Randy Connor at 1130 Lehigh St in Boulder, CO 80305:  On and before April 29, 2011, the employer did not ensure that a Werner 6 foot stepladder was used with the metal spreader or locking device engaged to hold the front and back sections in an open position. Employees placed the stepladder on the peak of the garage and leaned it against the eve of the roof on the 2nd level. The stepladder was in the closed position. This condition exposed employees to a fall hazard of approximately 8 feet from the top of the garage to the ground below.

29 CFR 1926.1060(a):  The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:    (a)  Randy Connor at 1130 Lehigh St in Boulder, CO 80305:  On and before April 29, 2011, the employer did not provide a training program for ladder use to train each employee in the procedures to be followed to minimize hazards related to ladders, such as, but not limited to, proper ladder selection for the designated task, proper use, and limitation of use. This condition exposed employees to a fall hazard of approximately 8 feet.     Abatement Note:  The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable:    (a)  The nature of fall hazards in the work area;    (b)  The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used;     (c)  The proper construction, use, placement, and care in handling of all stairways and ladders;     (d)  The maximum intended load-carrying capacities of ladders; and     (e) The standards contained in this subpart.
