29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Monarch Construction and Roofing, LLC at 635 40th Street, Boulder, CO 80305: On April 28, 2011, the controlling employer, the general contractor, did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment made by a competent person. Approximately five subcontracting roofing employees were removing and installing roofing materials on a one-story duplex without using a fall protection system. The pitch of the roof was approximately 4.5-in-12. This condition exposed employees to an approximate 8 foot fall hazard. Abatement Note: Abatement certification is required for this item (see enclosed Sample Abatement Certification Letter).
