29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) North side of new water tank; On or about 4/27/11 and at times prior thereto, an inspector without a means of fall protection was walking/standing on the top of the tank while talking to other several individuals and talking on his cell phone. Note: Abatement certification is NOT required for this item.
