29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Barrera Construction and Associates LLC at 635 40th Street, Boulder, CO 80305: On April 28, 2011, the exposing employer, the subcontractor, did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment made by a competent person. Approximately five subcontracting roofing employees were removing and installing roofing materials on a one-story duplex without using a fall protection system. The pitch of the roof was approximately 4.5-in-12. This condition exposed the employees to an approximate 8 foot fall hazard. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: (a) Barrera Construction and Associates LLC at 635 40th Street, Boulder, CO 80305: On April 28, 2011, the employer did not ensure that each employee engaged in roofing operations was trained to recognize the hazards of working at elevation and trained in the use of fall protection. Five employees were engaged in roofing activities at a one-story duplex with an approimate 4.5-in-12 pitch roof without the use of a fall protection system. This condition exposed the employees to a fall hazard of approximately 8 feet. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (1) The nature of fall hazards in the work area; (2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (4) The role of each employee in the safety monitoring system when this system is used; (5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; (6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; (7) The role of employees in fall protection plans; and, (8) The standards contained in this subpart.
