29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surfaces were not used as a means of access: a) On or about March 29, 2011, Wadman Corporation, as a controlling employer, failed to protect employees of J Nunez Masonry Inc (subcontractor) from falls while they accessed the top (fifth) scaffold level while performing masonry work because Wadman Corporation had not ensured that a ladder was provided for safe access from the fourth to the fifth level.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) 29 CFR 1926.451(g)(1): On or about March 29, 2011, Wadman Corporation, as a controlling employer, failed to ensure that J Nunez Masonry employees (subcontractors) were protected from fall hazards of over 15 feet while they walked and worked on upper levels of scaffolding without adequate guardrails or another fall protection system.
