29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surfaces were not used as a means of access: a) On or about March 29, 2011, employees were exposed to falls while they accessed the top (fifth) scaffold level while performing masonry work because the employer had not provided a ladder access from the fourth to the fifth level.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, were used on top of scaffold platforms to increase the working level height of employees: a) On or about March 29, 2011, an employee working from the 5th level of a scaffold was exposed to falls while he balanced on a cinder block to perform his work. The employee was elevated to the point that the single guardrail at the west end of the scaffold was at his knees and would not have prevented him from falling from the scaffold if the cinder block had shifted.
