CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level.  	(a)	Calahan Construction Services, 910 Santa Fe Blvd., Denver, CO 80204:  On and before May 5, 2011, the employer did not ensure that the two employees performing sign installation work off a scissor lift were protected from falling to a lower level.  Specifically, employees were witnessed standing on the mid and top rails of the scissor lift to perform work, which was to drill into the wall to install the metal frame for the sign.   Condition exposed employees to fall hazards of approximately 15 depending on the height to which the scissor lift was raised.    Abatement Note:  Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").

CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.     	(a)	Calahan Construction Services, 910 Santa Fe Blvd., Denver, CO 80204:  On and before May 5, 2011, the controlling employer did not ensure his employees were provided with adequate training concerning the moving and operating of a scissor lift.  Condition was evidenced by employees witnessed working by standing on the mid and top rails of the lift rather than moving the lift and adjusting the height into the proper position to perform the work.  Condition exposed employees to fall hazards of 15 feet and greater.    Abatement Note:  The training shall include the following topics, as applicable:    	(1)	The nature of scaffold hazards;  	(2)	The correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question;  	(3)	The design criteria, maximum intended load carrying capacity and intended use of the scaffold;  	(4)	Any other pertinent requirements of this sub part. CFR 1926.501(b) (10):  Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system;    	(a)	Calahan Construction Services, 910 Santa Fe Blvd., Denver, CO 80204:  On and before May 5, 2011, three employees working on a flat roof located at 910 Santa Fe Drive, were not protected from falling by a system as described above.  Specifically, an employee was witnessed and photographed leaning over the edge of the flat roof to assist two other employees working off a scissor lift to install the frames for a brand new sign without adequate fall protecteive measures in place.  Condition exposed employee to fall hazards of greater than 20 feet.    Abatement Note:  Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").

CFR 1926.503(a)(1):  The employer failed to provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  	(a)	Calahan Construction Services, 910 Santa Fe Blvd., Denver, CO 80204:  On and before May 5, 2011, three employees were witnessed working off a scissor lift and sections of a flat roof without adequate fall protection measures in place.  The fact that employees had adequate fall protective measures in place in their trucks yet failed to utilize them and additionally were working unsafely while standing on the mid and top rails on a scissor lift, despite the fact that the lifts height could have been adjusted to the correct height, all point to a lack of training. CFR 1926.503(a) (2) (iii):  The employer did not ensure that each employee has been trained by a competent person qualified in the standards contained in subpart M.  	(a)	Calahan Construction Services, 910 Santa Fe Blvd., Denver, CO 80204:  On and before May 5, 2011, the employer did not ensure that each employee who conducted work from low sloped roofs had been trained by a competent person.  The fact that employees had adequate fall protective measures in place yet failed to utilize them and additionally were working unsafely off a scissor lift, despite the fact that the lifts height could have been adjusted to the correct height, all point to a lack of training. Condition exposed employee to fall hazards of greater than 15 feet.    Abatement Note: The competent person shall be qualified in the following areas:    	(1)	The nature of the hazards in the work area;  	(2)	The correct procedures for erecting, maintaining, dissembling, and inspecting the fall protection system used;  	(3)	The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protections to be used;  	(4)	The role of each employee in the safety monitoring system when this system is used;  	(5)	The limitations on the use of mechanical equipment during the performance of roofing work in low-sloped roofs;  	(6)	The correct procedures for handling storage of equipment and materials and the erection of overhead protection;  	(7)	The role of employees in fall protection plans;  	(8)	The standards contained in subpart M.
